Maharashtra: High Court directs MSRTC to initiate disciplinary action against striking workers
22 November 2021: The Bombay High Court directed the Maharashtra government to initiate criminal proceedings against workers and unions on strike for permanent government employee status under the garb of preventing willing employees from joining work. The bench was hearing a contempt petition filed by the Maharashtra State Road Transport Corporation (MSRTC) against the unions and their members on indefinite strike since November 3.
Odisha: High Court upholds NHRC’s directive compensating kin of ASHA who died due to lack of healthcare
22 November 2021: The Odisha High Court upheld the directive of the National Human Rights Commission (NHRC) to pay Rs. 3 lakh compensation to the kin of an ASHA worker who died on her way to the hospital for delivery. She was forced to travel in an auto-rickshaw as the ambulance could not reach her village due to absence of proper road and mobile connectivity.
Supreme Court holds pension as deferred compensation, hard-earned benefit of employees
18 November 2021: A two-judge bench of the Supreme Court comprising Justices R. Subhash Reddy and Hrishikesh Roy directed the employer to pay a deceased employee’s pension to his widow who had been litigating since a decade. It did so while holding pension as “the deferred portion of the compensation for rendering long years of service” and “a hard-earned benefit accruing to an employee, in the nature of property.”
Jammu & Kashmir: High Court directs govt to file response, regularise daily wagers in judiciary
08 November 2021: The Jammu and Kashmir High Court directed the Law, Justice Parliamentary Affairs department to file its response so that daily wagers of the judiciary can be absorbed and regularised as Class IV employees within the stipulated three weeks. The court also flagged the inordinate delay of the govt in doing so, and directed payment of pay at par with other workers discharging similar work.
Maharashtra: Labour Court holds closure of Hotel Hyatt Regency illegal, orders relief to over 200 workers
04 November 2021: A Mumbai Labour Court has ruled the closure of Hotel Hyatt Regency in Mumbai as “illegal” under the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices (MRTU and PULP) Act, 1971. The court directed the Hotel’s owner Asian Hotels (West) to keep paying the 200-odd employees their wages and has restrained Hyatt Regency and Asian Hotels from disposing of or creating third interest on the properties owned by them.
Supreme Court holds that standards for retrenchment as per ID Act applicable even if appointment is irregular
03 November 2021: A two-judge bench of the Supreme Court comprising Justices Ajay Rastogi and Abhay S Oka held that the requirements specified under Section 25F of the Industrial Disputes Act 1947 for the retrenchment of an employee will apply even if the appointment was irregular. A Labour Court had initially termed the dismissal of a group of non-teaching employees in violation of the ID Act which was overturned by the Kerala High Court.
